High School Intern Wrongfully Detained by ICE Agents at Rhode Island Courthouse, Judge Personally Intervenes to Help

A high school intern with the Rhode Island Superior Court was wrongfully detained by Immigration and Customs Enforcement (ICE) agents, causing a judge at the courthouse to personally intervene.

The incident occurred on Thursday, Nov. 20, in Providence, CNN and WPRI 12 reported. It began when the teen, who is currently participating in an internship experience with the court, noticed someone taking photos of him in the courtroom, according to court staffers familiar with the situation, per the outlets.

Courthouse security requested that the person stop taking photos, at which point the person identified themselves as ICE, according to a staffer, per the outlets.

The teen appeared shaken by the encounter, at which point Superior Court Associate Justice Joseph McBurney then offered to drive him back to his high school, according to the staffer.

Video of the alleged incident shows ICE agents approaching what appeared to be McBurney’s car. They question McBurney and then restrain the teen’s arms behind his back before escorting him from the vehicle.

The teen, whose identity has not been shared publicly, was ultimately released by ICE agents after they checked his ID, per CNN and WPRI 12.

Assistant Secretary Tricia McLaughlin with the Department of Homeland Security stated that the agency “was targeting a child predator” during the Nov. 20 incident in a statement provided to PEOPLE.

“Officers briefly questioned someone who resembled the target. He was never arrested or taken into custody,” she added.

The Rhode Island Judiciary confirmed details of the incident in a press release obtained by PEOPLE.

“If not for the intervention of a Superior Court judge who insisted that ICE had wrongfully identified his intern as their target, this young person would have been taken into ICE custody. When the ICE agents verified their information, they confirmed that the intern was not the person they were looking for, and he was released,” the release stated.

“This egregious incident underscores both the community’s and the Judiciary’s concerns about how ICE is conducting its operations in Rhode Island,” said Rhode Island Supreme Court Chief Justice Paul A. Suttell, per the release.

Suttell went on to say that the Nov. 20 incident highlights a need to implement more remote hearings “in Providence County and beyond” to better serve the community “given this climate.”

“The courts are here to serve the people and the Judiciary remains steadfast in preserving and augmenting access to justice for all persons,” he added.

Gov. Dan McKee called the incident “an outrageous and indefensible act that could have completely upended a young person’s life,” in a statement shared on Facebook on Nov. 20.

“Rhode Islanders should not have to fear federal agents operating with such reckless disregard for the law and human dignity,” he added. “This was not a harmless mistake. It was the direct result of callous and chaotic policies by the Trump Administration.”
